By accessing this website, submitting a quote request, or placing an order with 407 Equipment Sales LLC, you agree to be bound by these Terms of Service and all incorporated policies. If you are using the site on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

You must be at least 18 years of age and legally capable of entering into a binding contract. Use of this website is prohibited where restricted by applicable law.

We work to provide accurate product descriptions, specifications, images, compatibility notes, lead times, and warranty details. Manufacturers may revise products or specifications without notice. Images may show optional accessories or representative configurations.

407 Equipment Sales LLC is the retailer and seller for orders placed and accepted through this website. We source equipment from manufacturers and third-party distributors. Depending on product availability, destination, and logistics requirements, an order may be fulfilled from a 407 Equipment Sales location, the manufacturer, a third-party distributor, or a contracted logistics facility.

A product listing or “In Stock” status means the item is offered for sale based on current catalog and availability information; it does not necessarily mean the unit is physically stored at our Apopka business address. The shipping origin may differ by product and order. 407 Equipment Sales LLC remains the customer point of contact for order communications, payment, support, authorized returns, and assistance with eligible delivery or warranty claims.

Third-party fulfillment does not change the accepted order price or the published policies that apply to the order. If availability changes before an order is accepted, we will contact the customer and provide the available options, which may include a revised estimate, an alternative product, or cancellation and refund of any captured payment.

Before completing an order, you are responsible for verifying all details relevant to your application, including model number, dimensions, power requirements, certifications, compatibility, and included accessories. The written accepted order and manufacturer documentation take precedence over general marketing language.

A quote is valid only for its stated time period and specified configuration. An automated order confirmation acknowledges receipt but does not by itself constitute acceptance, guarantee stock, or confirm final shipping or tax amounts.

We may verify payment, identity, inventory, destination, and delivery requirements before formally accepting an order. A standard order is accepted when we send a shipping confirmation or when the product ships, whichever occurs first. Custom or special orders are accepted as stated in their signed quote or deposit terms.

We may decline or cancel an order for inventory unavailability, payment failure, suspected fraud, pricing errors, restricted destination, or legal requirements. Any captured payment for a canceled order will be refunded as required.

Prices and availability may change before order acceptance. All taxes and any charges not included in the displayed price are disclosed before checkout completion. Installation, assembly, permitting, and other optional services are included only when expressly stated.

If an obvious catalog-data, typographical, or technical error affects an order price, we may correct the error and offer you the option to accept the corrected order or receive a refund for the affected item. We will not charge a higher corrected price without your explicit approval.

By placing an order, you authorize the charges shown in the accepted order and confirm that your payment and billing information is accurate and authorized. Payment methods are limited to those displayed at checkout.

For certain promotional products, payment by ACH or wire transfer may be required. This requirement will be clearly disclosed on the applicable product page or at checkout before order submission. Bank transfer orders remain on hold until funds are received and verified; processing begins only after payment has cleared. Customers must use only the official payment instructions provided by 407 Equipment Sales LLC through our official channels.

Shipping is available within the United States only. 407 Equipment Sales LLC arranges delivery to the address entered during checkout. Depending on availability and logistics requirements, an item may ship from a 407 Equipment Sales location, the manufacturer, a third-party distributor, or a contracted logistics facility. Our Apopka address is our business and support address; it is not a guaranteed ship-from or customer-pickup location. Pickup is available only when confirmed by us in writing.

Free Ground Shipping is available at no additional cost, with an estimated delivery time of 7–14 business days. Priority Shipping is available for a flat $599.00 per order, with an estimated delivery time of 5–7 business days. Delivery windows are estimates in business days and exclude weekends and federal holidays.

Unless otherwise stated, freight delivery is curbside or dockside. You must provide a correct delivery address, safe access, an authorized recipient, and appropriate unloading equipment. Missed delivery appointments, storage fees, redelivery costs, or address corrections caused by the customer may be charged at actual cost.

Our Return and Refund Policy is incorporated into these Terms. Eligible products may be returned within 35 days in accordance with that policy. A Return Authorization is required before sending any item back. Product-specific terms may designate freight, custom, special-order, installed, fueled, used, or final-sale items as non-returnable for customer-preference returns. These restrictions do not limit rights related to confirmed defects, incorrect items, or written warranty coverage.

Eligible products may include manufacturer warranty coverage ranging from 1 to 5 years depending on the product and manufacturer. A manufacturer warranty applies only when identified for the product and is subject to the manufacturer’s written terms, registration requirements, exclusions, and claim process.

407 Equipment Sales LLC may assist in routing a warranty claim but does not unilaterally modify or decide manufacturer warranty outcomes. We do not provide a separate store warranty unless displayed in writing before purchase. Nothing in these Terms disclaims an implied warranty or remedy that applicable law does not permit us to disclaim.

References to “buyer protection” describe our store-support process: secure checkout, written order confirmation, shipment tracking, and assistance with eligible transit-damage, return, and warranty claims under the applicable published policy. Buyer protection is not insurance, escrow, a third-party guarantee, or an unconditional promise of a refund, replacement, or claim approval.

Equipment sold by 407 Equipment Sales LLC may involve lifting, electrical, fuel, fire, pressure, and other hazards. You are solely responsible for qualified selection, proper site preparation, permits, code compliance, installation, training, safe operation, maintenance, and disposal.

Always follow all manufacturer instructions and capacity ratings. Do not install, energize, fuel, or operate damaged, incomplete, or incorrectly delivered equipment before resolving the issue with our support team. Customer service guidance does not replace licensed installers, engineers, safety professionals, or qualified technicians.

Product prices exclude sales tax. 407 Equipment Sales LLC is registered for Florida Sales and Use Tax and collects applicable Florida state and destination-county sales tax on taxable orders delivered in Florida. Tax is calculated from the shipping address and itemized before order submission. Tax-exempt purchasers must provide valid, matching documentation before checkout or fulfillment. Purchasers remain responsible for use-tax or other obligations where tax is not collected.

You may use this website only for lawful shopping, account management, and business purposes. You may not interfere with website security or operation; introduce malicious code; impersonate another person or entity; submit fraudulent payment or identity information; scrape or systematically extract website content without written permission; or use products for prohibited export, sanctions, or end-use violations.

You agree not to export, re-export, transfer, or use a product in violation of applicable US or international law.

The website design, original text, graphics, logos, images, and compilation are owned by or licensed to 407 Equipment Sales LLC and are protected by copyright and other intellectual property laws. Manufacturer names, marks, manuals, and product materials belong to their respective owners. No ownership is transferred except the limited right to use this website for its intended purpose.

If you submit a review, photo, or other user-generated content for publication, you represent that you hold the necessary rights and grant 407 Equipment Sales LLC a non-exclusive, royalty-free license to display and promote it in connection with our store.

Payment processors, carriers, manufacturers, and other linked services are independent third parties unless expressly stated. Their own terms and policies apply separately. We are not responsible for third-party content or conduct beyond the extent required by our written commitments or applicable law.

To the fullest extent permitted by law, this website and its general content are provided “as is” and “as available.” We do not guarantee uninterrupted or error-free access. This disclaimer does not replace an accepted order, written product warranty, or any right that applicable law does not allow us to exclude.

To the fullest extent permitted by law, 407 Equipment Sales LLC will not be liable for indirect, incidental, special, punitive, or consequential damages — including lost profits, lost data, or lost business opportunity — arising from the website or any transaction, even if advised such damage may occur.

Our aggregate liability for any claim relating to a specific product or order will not exceed the amount paid to us for the product giving rise to the claim. These limitations do not apply to liability that cannot be legally limited, including fraud, willful misconduct, or personal injury caused by our own conduct.

To the extent permitted by law, you agree to defend and indemnify 407 Equipment Sales LLC from third-party claims, losses, and reasonable legal costs arising from your unlawful use of the website, material breach of these Terms, infringement of another party’s rights, or unsafe or unlawful installation, operation, transport, or resale of a product you purchased from us. This obligation does not apply to the extent a claim results from our own wrongful conduct.

Neither party is responsible for delays caused by events beyond reasonable control, including severe weather, natural disasters, labor disruptions, carrier interruptions, war, terrorism, epidemic, cyber incidents, government action, utility failure, or manufacturer, distributor, or fulfillment-partner interruptions. Payment and refund obligations already due are not excused by such events.

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where federal law or a non-waivable consumer protection law applies. The parties consent to exclusive jurisdiction in the state and federal courts located in Bay County, Florida.

Before filing a formal claim, please send a written description of the issue and your requested resolution to support@407equipmentsales.com so the parties can attempt an informal resolution first. This notice requirement does not shorten any applicable legal deadline.

You must provide accurate information, protect your account credentials, and notify us promptly of any suspected unauthorized use. You are responsible for all activity conducted through your account to the extent permitted by law. We may suspend or close accounts for security concerns, fraud, or violation of these Terms.

Our handling of personal information collected through this website is governed by our Privacy Policy. By using this website, you consent to those practices.

If any provision of these Terms is found unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in full force. A waiver of any breach must be in writing and does not waive any subsequent breach. You may not assign an accepted order or these Terms without our written consent. We may assign them in connection with a merger, financing, or sale of business assets, subject to applicable law.

These Terms, the accepted order, and incorporated policies constitute the complete agreement for the covered transaction.

We may update these Terms by posting a revised version with an updated date. The Terms in effect when an order is accepted continue to govern that order unless a change is required by law or agreed upon in writing.
